1. What this Privacy Policy relates to
This policy concerns the manner in which we, Arnold Excelz Limited (AEL), obtain, keep, and distribute information gathered by us from users of our website www.arnoldexcellz.com. This policy relates to the same website and all products plus services offered by AEL.
We are an employment business in the practice of engaging individuals (workers) in employment with our hirer clients.
2. How we gather personal data
We may collect data of a personal nature in a number of ways, including, but not limited to, our website, and in connection other activities and services so connected to the same site. Users of the site may be required to provide contact details such as email address, telephone number, and so on. Further avenues of collecting personal data directly from you includes your correspondences, application forms, CV, meetings with us and/or other parties acting on our behalf, employers/our hirers, telephone communications with us and/or other parties acting on our behalf, social media, and so on.
3. Personal data so gathered by us from users of the said site will be processed by us as a “data controller” (DC). Meaning of DC is simply that we hold the responsibility (on our own or acting jointly with another party) for deciding how we choose to maintain and use such personal data so obtained by us.

5. The data we do obtain and maintain relating to your Personal data, or personal information, simply means any information about a person from which that party can be so identified. It does not include data where the identity has been removed (anonymous data). We may gather, maintain, and transfer such personal data concerning you concerning your name, title, date of birth, nationality, gender, and place of birth, address, email address, telephone numbers, next of kin, and so on.
6. Please bear in mind that we also obtain, maintain, keep, and transfer data to relevant interested third parties including governmental departments, data about you concerning the following:
• Worker Status Data including visa information, passport information, and information relating to your right to work in the UK.
• Payroll and PAYE Data including bank details, national insurance number, tax code, information relating to hours worked and rate of pay. For limited liability companies, this will include your company registration certificate and information pertaining to your public liability insurance.
• Criminal Record Data, for a DBS Check, including the last five years of residential address history.
• DVLA Data, including details on driving history like penalty points, or endorsements.
• Medical History Data, including any past or current, chronic or mild, illnesses.
• Job History Data, including previous job history and past employer references.
7. Your personal data will only be used where we are legally permitted to so use such information. Hence, we will use your same data in the following situations:
• Where it is required for the fulfilment of an employment contract whether temporary or permanent, and you are the concerned 'potential candidate'.
• Where it is required for the protection of our legitimate interests (or those of a third party) and your interests and fundamental rights do not override such interests.
• Where we are legally obliged to divulge such personal data to external parties including governmental departments.
8. It is our practise to avoid obtaining sensitive personal data from you concerning the following: Politics, religious or philosophical beliefs, sexual orientation, and race or ethnic origin. Should you, however, provide us with such sensitive personal data or any other additional information concerning your circumstances, we will only use that data for the purposes of our relationship with you and providing our recruitment services to suit your circumstances. This may be for one or more of the following reasons:
• with your absolute consent (in limited circumstances);
• where we are legally obliged to divulge to such data in connection of your employment booking through our services;
• where the processing is required for the purposes of preventive or occupational medicine or for assessing your working capacity;

You can opt out of providing us with information concerning you, however, in so doing, we will not be able to fulfil our legal obligations to you, our clients and the relevant governmental departments. Most importantly, we would be hindered in our attempts to place you in employment with clients where relevant personal information from you are lacking. Should such situations occur, we will notify you of the same and advise you on steps to take to excel in your career.
10. Disclosures of your personal data
We do not sell, trade, or rent personal information of others. We do share personal information with hirers or other third parties in connection with the provision of our services. We may also disclose personal data to:
• third party service providers who process data on our behalf, such as:
• outsourced payroll services;
• IT support;
• professional advisers including lawyers, bankers, auditors and insurers for the purpose of providing consultancy, banking, legal, insurance and accounting services to us;
• HM Revenue & Customs, regulators and other authorities who require reporting of processing activities in certain circumstances;
• third parties to whom we may to sell, transfer, or merge parts of our business or our assets. We may also venture into acquiring other businesses or merge with them. Should such changes occur, the new owners may keep and maintain your personal data in the same manner as set out in our privacy policy. We require all our data processors to respect the security of your personal data and act in accordance of their legal obligation to the same. We have a strict rule that our data processors do not make use your personal data for their own purposes.

You personal data will not be transferred outside the United Kingdom.

However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances. We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.

For accounting purposes, your identity, payroll and PAYE data will be retained indefinitely since payroll data cannot be deleted.
12. Your rights in respect of your personal data You have certain rights in respect of the personal data that we process about you (where we determine the purpose and means for which that personal data shall be processed):
• the right to request access to the personal data that we hold about you and how we process it;
• you may have the right in accordance with applicable data protection law to have personal data we hold about you rectified or restricted;
• you may, in some circumstances, have the right to have personal data we hold about you deleted (although note that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request);
• in some circumstances, you may have the right to receive or ask for your personal data to be transferred to a third party;
• you have the right to object to how we process your personal data where that processing is based upon legitimate interests and there are no compelling grounds for the continued processing of that data;
